We live in a country of immigrants, but somewhere along the line we chose to establish a nation ground on white, Anglo-Saxon, protestant tenets, ignoring the rich mix of cultures that make us who we are. According to Sonia Nieto, Multicultural education cannot be understood in a vacuum but rather must be seen in its personal, social, historical, and political context (1996, p. 1).Addressing Education ReformDuring the 1950s in the United States, the family unit seemed solid and pediatrician Dr. benzoin Spock gave mothers credit for knowing instinctively how to raise their children. This was in contrast to behaviorist John Watsons method of rigid discipline, and Spocks book The Common Sense Book of thwart and Child Care (1946) was so popular it led to gradual erosion of the rules of behavior. In the meantime, a 1954 Supreme Court ruling that public schools must be integrated was virtually ignored until 1957 when nine black students were enrolled at a previously all-white school in Little Rock, Arkansas. Bounced Check, Return of Unsold Books, Safety at work Places Essay

Bounced Check, Return of Unsold Books, Safety at sound Places - Essay theoretical accountIn respect to this provision, Watson could be presumed to be aware that the check ordain bounce if one or ii conditions occur. The first one is, in representative he did not involve an account with the drawee during the stated date or the issue time, whichever comes later. The second reason could be, if the check appropriately declined payment for lacking liberal funds, when presented within 30 days after the stated date or issue date, either of which comes later, and if the responsibility of Watson, or any other occasiony who whitethorn be involved happens not to be set free through payment, not later than ten days following the bouncing date. If Watson successfully satisfies that the two conditions did not arise, then it is hard to place any blame on him, therefore, Wilson can easily prevail against the stores intentions of reclaiming the computer from him as it will be presumed that i t was legally transferred. 2. Return of unsold books, which are damaged. Both the express and implied conditions of contract between Press Publishers and Boardwalk Books must be satisfied. Although Press Publishers could not have expressly stated that the unsold books must be returned in good condition, there is an implied responsibility for the Boardwalk Books to exercise due care in order to suspend damage of books while in the books store. The fact that just about pages had been ripped off by customers, while coffee had been spilled over others is a blatant negligence on the part of Boardwalk Books. Press Publishers can refuse to accept the 20 copies that had been destroyed and successfully sue Boardwalk Books for negligence. The law presumes that Boardwalk Books should act professionally and with due care, to avoid any predictable danger that could happen in its premises, upon goods stored there but owned by the third parties. On the other hand, Boardwalk Books can raise a d efense against some books which were destroyed for merely sitting on the bookshelf. They could argue that Press Publishers had supplied books of low quality hence, they easily get damaged. To prevail against Press Publishers, Boardwalk Books must prove beyond doubt that they exercised due care, and could not have done anything to prevent the books from getting destroyed. Boardwalk Books may want to argue that the problem arose from the fact that the publishers goods were merchandising very slowly, however, such argument many not hold any water since it does not prevent them from taking care of the goods. 3. Safety at work Places All employers are responsible for the health and safety of all their employees. Laws have been enacted to protect employees from hazards at their work places. Examples of such laws are the Fair Labor Standards sour (FLSA), Occupational Safety and Health (OSH), and the Mine Safety and Healthy Act of 1977. Burka’s book Essay Example for Free

Burkas withstand EssayOn the surface procrastination is an ideologically and psychologically fixed term it is presumed that procrastination is emphatically bad and is to be avoided. Thus there exists a whole plethora of books which seek to cure this t rarityency of delaying. And as far as such efforts go, this book is no exception, rather her book like so many others in its category systematically prescribes how to overcome what the ancients like St. Augustine called acedia (depression leading to inordinate delays in doing anything within a time frame. What Burka misses is that it may be fine to procrastinate on doing ones laundry over writing a thesis to delay shaving over finishing a novel started from last night. Burkas book suffers from giving equal importance to each work and an overt tendency to pre-plan everything. This need to plan and work towards goals is a recent phenomenon in self-help literature. Time management books especially hinge on the stage setting of g oals. There is a fear that by over-regimentation they kill all spontaneity and joy from life and make us automatons. But if one argues that the book is mean for clinically malefficient procrastinators then one ought to point out that self-help books are hardly written for those who need mental help. There is another point regarding this book. It is definitely a secularization of the concept of procrastination. In the seventeenth and the eighteenth centuries and even later, delaying was inevitably associated with the cardinal sin of sloth. This book opens up the issue for humanistic debates, albeit their humanism is root in the ontogeny of Freud.Burka and Yeun devote a whole chapter to the interrogation of procrastination as a formed infantile reaction to clinically pregnant psychological events. Fear is seen as the source for the ultimate interiorization of chronically delayed work habits. They list many different fears the fear of losing, the fear of being humiliated, and so fort h Ultimately it is seen that all the various phobias are just related to the process of self-actualization and Jungian individuation. In a very interesting and signifi stomacht paper Jennifer M. Kosmas1 gives a similar phobic-oriented account of procrastination.Whereas she and other experts in the field are highly technical and do not try to see how the tendency to delay can be prevented Burka and Yeun posit a reductive approach to paradox solving and thus, delay negation. In this they follow the beaten path, not merely of psychiatrists except of self-help gurus and time management experts like the legendary Stephen Covey. Covey in his The Seven Habits of Highly Effective People asks us all to problem-solve by breaking the problem into parts and then working towards the solution within fixed time frames. All this is traditional and time-tested but the real problem for true procrastinators in not to only know the cause of their disease but rather for them, it is a mortal combat aga inst the inertia caused by time itself. This is where the book fails. It move short of giving any really effective formula to any reader which would impel him or her to just get up and doing a thing. single can plan and write all sorts of goals and have strict time frames this book creates a programme of two weeks for procrastination de-addiction but at the end one might just refuse to go running according to the planned start of any exercise regimen. In the final analysis, this book is a clearly written and popular account of procrastination but it fails miserably as a serious book with any real clinical significance. myriad studies have shown that procrastination is often psychosomatic and related with depression. The authors, in spite of being practicing psychiatrists, do not really tackle these issues. The parable like examples strewn passim the book are just Chicken Soup (the popular series) sort of stories. The more serious sort of reader and patient will do transgress to s tudy the original Freudian works on infantile hysteria and then read Stephen Coveys books.

Utilitarianism and Kantianism Essay Example for Free

Utilitarianism and Kantianism EssayIn the history of ethics, two major viewpoints emerge the consequentialist and the nonconsequentialist. The consequentialist view is based on or concerned with the consequences of ones chipions, fleck nonconsequentialist views are not. One major consequentialist ethical theory is utilitarianism. This theory, whose principle architects were Jeremy Bentham (1748-1832) and John Stuart Mill (1806-1873), derives its name from utility, which means usefulness. Utilitarianism is commonly found in two forms act utilitarianism and direct utilitarianism.Act utilitarianism essentially states that everyone should perform that act which will bring about the greatest good for everyone affected by the act. Fundamentally, this theory requires that each separate assess the situation and determine which act would bring about the greatest amount of good consequences for the maximum number of persons involved. While act utilitarianism sounds nearly ideal, at t hat place are several criticisms to this theory. For one, it very difficult to ascertain what consequences are good for otherwises, given that all individuals hold different nonpluss of morals, values, and beliefs.Furthermore, there is a certain impracticality in having to begin anew because not all acts and situations are entirely different. It would also be difficult to educate others given there is no distinct set of rules or guidelines. And finally, one must consider the rights of those few whom do not benefit from that action which will bring about the greatest good. To provide answers to galore(postnominal) of the above mentioned criticisms, rule utilitarianism was established. In this form, utilitarians believe that everyone should establish and follow those rules that bring about the greatest good for all concerned. In other words rule utilitarians, from experience and careful reasoning, try and establish a series of rules that when followed, will yield the greatest good f or humanity (i. e. never kill except in self defense). Associated with rule utilitarianism are some of the same criticisms encountered with act utilitarianism. Again, it becomes difficult to determine consequences of others. Furthermore, non-rule moralists argue strongly that there is no rule in which one could not find at least one exception. In contrast, one major nonconsequentialist theory is Kantianism. This theory, often called Duty Ethics, was formulated by Immanuel Kant (1724-1804). Kant believed that zilch was good in itself, except the attribute good will, which acts in accordance with rules regardless of consequences. other human attribute Kant proposed was equally of importance, was ones efficiency to reason. He therefore believed it was possible to establish a valid set of absolute moral rules on the basis of reason alone without reference to God.Kants two requirements for an absolute moral truth include both logical consistency (cannot be self-contradictory as a state ment) and universalizability (stated so as to feed to everything without exception). At the center of Kants moral philosophy is the categorical autocratic from which all our moral duties originate. Such principles of morality are described as an imperative because they command a certain course of action. In other words, it is a categorical imperative because it commands, independently, particular ends and desires of the moral agent.According to Kant, these imperatives must be obeyed in their entirety, by all, and in all circumstances. For example, someone who is only inclined to be generous, rather than generous out of duty, is not fully moral. Like many other moral theories, there are several criticisms of Kantianism. In some circumstances duties, which Kant describes as universal, conflict. For example, should one break a promise (which is immoral by Kants standards) to keep another from being harmed? Sometimes it is impossible to ignore the outcomes of our actions.Kants approac h also allows for no exceptions which can result in negative consequences. Another criticism to Kantianism is the question of whether or not a qualified rule is any less universalizable then on that is unqualified. In other words, Kant never exalted between making a rule and qualifying it. And lastly, what happens when ones inclinations and duties are the same? Does that then make them an immoral being in the truest mavin of the word? Most would argue that it is better for someone to do something because they want to rather, than because it is their duty.
